TERMS and CONDITIONS

All orders subject to acceptance by Winter Walking’s general office.

TERMS: Unless paid via credit card, Net 20 days. Invoices not paid after 30 days will be subject to late charges of 2% of invoice amount monthly, starting 30 days from date of invoice.

DELIVERY: F.O.B. Point of Origin

RETURNED GOODS POLICY:

• No merchandise will be accepted for return without prior written authorization.
• Unauthorized returns will be refused and returned to sender freight collect.
• Items must be returned within 30 days of the issuance of an RMA#
• Items must have been purchased within one year of the return request
• Items must NOT have been worn or damaged in any way
• All returned items are subject to inspection prior to approval
• Material credit issued upon approval
• A 25% restocking charge will be made on all returned goods unless considered defective.
• Accepted Returned Goods will be for credit only against future purchase
• All unused credits, material or otherwise are good for one year from the date of issue

Merchandise damaged in shipment should be noted on the delivery receipt of the carrier. Concealed damage should be reported to the carrier by telephone or letter. Carrier will promptly send an inspector. Inspection report should be sent to WINTER WALKING with a copy of the bill of lading. WINTER WALKING will then advise disposition of the merchandise and initiate credit.

Any order form or other form of Buyer containing terms and conditions of sales or shipment shall not have the effect of adding to, modifying or deleting the terms and conditions hereof.

IMPORTANT NOTICE TO PURCHASER
All statements, technical information and recommendations contained herein are based on tests we believe to be reli-able, but the accuracy or completeness thereof is not guaranteed and the following is made in lieu of all warranties, ex-pressed or implied.
Seller’s and manufacturer’s only obligation shall be to replace such quantity of the product proved to be defective. Nei-ther seller nor manufacturer shall be liable for any injury, loss or damage, direct or consequential, arising out of use of or the inability to use the product. Before using, user shall determine the suitability of the product for his intended use, and user assumes all risk and liability whatsoever in connection therewith. No statement or recommendation not contained herein shall have any force or effect unless in an agreement signed by officers of seller and manufacturer.
